TL*THE CONTACT OWNS A 1992 CHEVROLET CAPRICE CLASSIC. WHILE DRIVING APPROXIMATELY 20 MPH, THE BRAKES FAILED WHEN THE CONTACT ATTEMPTED TO STOP AT A STOP SIGN. THE CONTACT SHIFTED THE VEHICLE INTO A LOW GEAR AND ALLOWED IT TO COAST TO A COMPLETE STOP. SHE TOOK THE VEHICLE TO A LOCAL MECHANIC AND THEY DISCOVERED A LEAK FROM THE ABS MODULATOR. THE DEALER STATED THAT HER VIN WAS NOT INCLUDED IN NHTSA CAMPAIGN ID NUMBER 97V217000 (SERVICE BRAKES, HYDRAULIC:ANTILOCK), ALTHOUGH THE FAILURES WERE IDENTICAL. THE CONTACT WOULD BE RESPONSIBLE FOR THE REPAIR COSTS. THE VEHICLE HAS NOT YET BEEN REPAIRED. THE FAILURE AND CURRENT MILEAGES WERE 193,806.

I OWN A 1992 CAPRICE STATION WAGON. AFTER DRIVING FROM NEW YORK TO OKLAHOMA IN JANUARY OF 2001, I EXPERIENCED TOTAL BRAKE FAILURE AS A RESULT OF THE LEAKING OF THE ABS MODULATOR ON THIS CAR. A USED ABS MODULATOR WAS PURCHASED AND WAS USED TO REPLACE THE FAILED PART. ON 4-24-2001, I CAME ACROSS A SAFETY ALERT FOR THIS TYPE OF VEHICLE IN THE INTERNET THAT INDICATED THAT THERE HAD BEEN A RECALL FOR THE PART THAT HAD FAILED IN MY VEHICLE. THE RECALL # IS GM CAMPAIGN #97058 AND THE NHTSA # IS 97V217. THE SAFETY ALERT STATES THAT "DEALERS WILL INSPECT THESE VEHICLES AND REPLACE THE ABS MODULATOR." TO THE BEST OF MY KNOWLEDGE, THIS WORK WAS NEVER DONE NOR DID I EVER RECEIVE NOTICE OF A RECALL. I SPOKE WITH A CUSTOMER ASSISTANCE PERSON AT 1-800-222-1020 REGARDING THIS MATTER TODAY AND WAS INITIALLY TOLD THAT MY VEHICLE WAS NOT INCLUDED IN THE RECALL. AFTER ABOUT 20 MINUTES, THIS PERSON AGREED THAT NOT ONLY WAS MY VEHICLE INCLUDED IN THE RECALL BUT THAT THE RECALL WORK HAD BEEN PERFORMED ON 5-27-99 WHEN THE VEHICLE HAD 91K MILES. I CAN ASSURE YOU THAT THIS WORK WAS NEVER DONE AND THE PART WAS NEVER REPLACED ON THIS VEHICLE. I HAVE THE ORIGINAL PART AND THE USED PART THAT I PURCHASED TO REPLACE IT SEEMS TO BE OK FOR NOW. THE CUSTOMER ASSISTANCE PERSON WAS UNABLE TO TELL ME WHICH DEALERSHIP PERFORMED THE WORK. SHE GAVE ME A FILE # WHICH WAS C03934587. I BELIEVE THAT CHEVROLET SHOULD BE RESPONSIBLE FOR THE COST OF A NEW ABS MODULATOR AND THE LABOR TO INSTALL IT. THIS SEEMS TO BE THE INTENT OF THE RECALL NOTICE AS I READ IT. WHILE DRIVING MY CAPRICE, I PULLED AT THE SEAT SHOULDER BELT TO READJUST ITS POSITION. IT RELEASED, ALLOWING ALL THE BELT MATERIAL TO BE LOOSELY HELD AROUND ME. I AM NOT AN ATHLETIC FEMALE AND DID NOT PULL HARD. I CONTACTED GM. THEY STATED THAT ALTHOUGH SEAT BELTS ARE SAFETY DEVICES, THEY ARE ONLY GUARANTEED TO FUNCTION DURING THE WARRANTY PERIOD OR 36,000 MILES. THEY SAID I WAS RESPONSIBLE TO PAY TO HAVE THE SEAT BELTS REPLACED AND WOULD NOT HAVE ASSUMED ANY LIABILITY HAD A WRECK OCCURRED WHEN THE SEAT BELT FAILED. THE CASE NUMBER AT GM IS 990281010. I PURCHASED MY FIRST VEHICLE, NO LINE OF CREDIT AT A AUTO AUCTION, CAR COST 2,648.07 AND PAYMENTS $167.61 TOTAL 8,039.62 PAID $ 1,000.00 CASH DEPOSIT. THE CAR BROKE DOWN THE NEXT DAY, I HAD IT TOWED TO A GARAGE, THE WARRANTY WOULD NOT FIX THE CAR. GARAGE OWNER CALLED AUDITION OWNER TO PICK UP THE CAR AS REPO WITH MY APPROVAL, AND I ALSO CALL AND GAVE ADDRESS TO CAR AUCTION DEALER. THEY DID NOT RESPOND, THE GARAGE OWNER WITH MY PERMISSION SOLD THE CAR TO SOMEONE WHO WERE TO TAKE OVER THE CAR PAYMENTS. THE GARAGE PERSON SAID HE DID, AND GAVE ME $300.00, AND SAID THERE IS NO NEED FOR ME TO DO PAPER WORK A LIEN FROM THE PEOPLE WOULD BE SUFFICIENT, AND THEY WILL CONTACT THE AUTO AUCTION AND TAKE OVER THE PAYMENTS. I PLEADED CAN I GET PAPER SO I CAN FOLLOW UP, AND THE GARAGE OWNER KEPT AVOIDING ME. NOW I WAS GIVEN A CALL FROM THE AUTO AUCTION OWNER, THEY LOCATED THE CAR, IT WAS SOLD THREE TIMES ALL STILL HAVING ME AS THE OWNER, AND A LIEN WAS NEVER PLACED ON IT, NOR DID ANYONE CONTACT THE COMPANY TO TAKE OVER THE PAYMENTS. MY MOM SAID I TRANSACTED THIS BUSINESS AS VERY GREEN, AND THEY ALL TOOK ADVANTAGE OF ME. NOW I WILL BE SUED, IF I DO NOT BRING THEM 2,500 DOLLARS FOR HIRING AN INVESTIGATOR TO LOCATE THE CAR.
